Starting July 1, 2024, there are significant changes coming to the telehealth certification requirements that you need to be aware of. Let's dive into the details!
The Indiana Professional Licensing Agency (PLA) has announced new regulations under Sections 5 and 6 of Senate Enrolled Act 132-2024, signed into law by Governor Holcomb on March 11, 2024. These changes will affect all "Telehealth Certificate†and "Telehealth Facility Certificate†holders.
Key Changes Effective July 1, 2024
- All previously issued "Telehealth Certificates†and "Telehealth Facility Certificates†will be terminated permanently.
- Practitioners will no longer need to complete the certification requirements previously required under Indiana Code § 25-1-9.5-9.
- Employers or contractors will no longer need to complete the certification requirements previously required under Indiana Code § 25-1-9.5-9.
- Previously issued "Telehealth Certificates†will no longer need to be renewed with the practitioner's primary, unlimited Indiana license.
However, it's crucial to note that all practitioners must still be properly licensed in the state of Indiana to practice, even for telehealth services.
Practitioners Outside Indiana
For those practitioners physically located outside Indiana but providing telehealth services to patients in Indiana, the following points are important:
- Such practitioners are considered to be providing health care services in Indiana.
- They must establish a provider-patient relationship under Indiana Code § 25-1-9.5.
- They must determine whether to issue a prescription under Indiana Code § 25-1-9.5.
- They agree to be subject to Indiana's jurisdiction and laws for any claims arising from their services.
This means that providing telehealth services to Indiana residents will subject out-of-state practitioners to Indiana's legal and procedural standards.
Next Steps
Through June 30, 2024, all practitioners and their employers or contractors must continue to comply with the current certification requirements. The PLA will update its website with appropriate guidance as the effective date approaches. Practitioners and stakeholders are encouraged to familiarize themselves with these changes and consult their legal teams for guidance.
