One crucial aspect of this is the initial evaluation process for students who may require special education services. In West Virginia, there is a specific timeline that schools must adhere to when conducting these evaluations, known as the 80-Day Timeline.

What is the 80-Day Timeline?

The 80-Day Timeline refers to the period within which an initial evaluation must be completed once a referral is made. This timeline is calculated from the date of referral, and it spans 80 calendar days. Importantly, this timeline includes state holidays such as Spring Break, Christmas, and Thanksgiving, meaning these days are not excluded from the 80-day count.

Steps for Compliance

To ensure compliance with the 80-Day Timeline, school districts must follow a series of steps:

Handling Delays

In instances where the evaluation is not completed within the 80-day period, a reason code must be selected from the Over 80 Days Reason list. If the reason code "01 – Extenuating Circumstances" is chosen, additional explanation is required. This step is crucial for maintaining transparency and accountability in the evaluation process.

Generating Reports

To track and manage evaluations effectively, reports can be generated using the IVI.EVAL – Initial Evaluation menu in the Special Education Reports system. Here's how to generate a report:

  1. Click on the Calendar icon next to the first block after the 80 Days Date Range to select the report's start date.
  2. Click on the Calendar icon next to the second block after the 80 Days Date Range to select the report's end date.
  3. Select the type of report you wish to generate from the dropdown menu.
  4. Click Submit to generate the report.

These reports will display critical information, including the consent to evaluate date, the 80-day due date, the eligibility determined date, eligibility status and exceptionality codes, and any reason codes with explanations if applicable.
