Ensuring that students with disabilities have access to, participate in, and make meaningful progress in the general education curriculum is a key priority in Delaware. To support this mission, students may be eligible for specialized services or educational supports tailored to their unique needs. Here’s a straightforward guide to understanding the process and securing these vital services.
Step 1: Request an Educational Evaluation
If a parent or educator notices that a child is struggling in school, they can request an evaluation for Special Education services. This is the first step in determining whether a student qualifies for specialized supports.
Once written parent permission is obtained, the school has either 45 school days or 90 calendar days (whichever comes first) to complete the evaluation and convene a meeting with the IEP team to review the results.
If a parent disagrees with the evaluation results, they have the right to request an Independent Educational Evaluation (IEE) by an outside expert, which the school may be required to fund. The school can ask for the parent's reason for disagreement, and the IEP team must consider the findings of the IEE.
Step 2: Confirm Student’s Eligibility for Services
The IEP team documents their review of data, discussions, and the eligibility decision in the Evaluation Summary Report. If the team determines that the student is eligible for Special Education services, they will proceed to develop an Individualized Education Program (IEP) to address the student’s needs.
Step 3: Develop an Education Program
Within 30 calendar days of confirming a child's eligibility for special education and related services, the school or district assembles a knowledgeable team. This team includes the parent and other individuals familiar with the child’s disability and the specific special education services and programs available.
The team reviews the child's evaluation data and other relevant information, assesses the child's strengths and needs, and collaborates to develop an Individualized Education Program (IEP). This program is tailored to help the child succeed academically and personally.
