The Provision of a Free Appropriate Public Education (FAPE)
Ensuring that all students, including those with disabilities, have access to a Free Appropriate Public Education (FAPE) is paramount. School districts must ensure that students with disabilities have the same opportunities as their peers, in the least restrictive environment, by delivering the special education and related services outlined in their IEPs or 504 Plans.
Types of Mental and Behavioral Health Services and Supports
ODE acknowledges the critical role that various school staff play in supporting students' mental and behavioral health. These services are provided by:
- School Counselors: Assist students in developing decision-making skills, understanding educational opportunities, and setting career goals.
- School Psychologists: Assess students' mental aptitude and emotional development, design educational programs, and consult with parents and staff.
- School Social Workers: Assess factors affecting learning, provide intervention strategies, and coordinate resources.
- Other Qualified School Personnel: Provide emotional supports, ensuring they are trained and credentialed to deliver these services.
Board-Licensed Mental and Behavioral Health Providers
In addition to school-based staff, board-licensed providers like psychiatrists, psychologists, and clinical social workers deliver mental health services within their professional scope. These providers play a crucial role in supporting students' well-being.
Student Privacy, FERPA/HIPAA
Maintaining student privacy is essential. All records created during the provision of school health services are considered education records under FERPA. It's crucial to post confidentiality limitations and follow mandatory reporting protocols for any concerning disclosures.
Medicaid Billing
School districts can bill Medicaid for services provided to students under their IEP or IFSP, as long as specific conditions are met, such as being an enrolled School Medical provider and obtaining written consent. However, services by TSPC-only licensed practitioners are not eligible for Medicaid reimbursement.
